("Agency," "we," "us," "our"). By accessing our website or engaging our services, you agree to these terms. If you do not agree, please do not use our services.


1. Introduction


Allison Ishman Creative Agency provides digital marketing, advertising, and business strategy services. These Terms and Conditions apply to all clients, users, and visitors engaging with our services or website.


2. Acceptance of Terms


By using our website or services, you acknowledge and agree to be bound by this Agreement. We reserve the right to modify these terms at any time, with changes taking effect immediately upon posting. Continued use of our services constitutes acceptance of the revised terms.


3. Services


The Agency offers marketing, advertising, consulting, and related digital services. Service details and deliverables are outlined in individual client agreements or proposals. We do not guarantee specific results, as outcomes depend on various factors including industry, competition, and market trends.


4. Payment Terms


All payments for services must be made according to the terms specified in client contracts or invoices. Unless otherwise agreed:


Payments are due upfront or according to an agreed schedule.Late payments may result in service suspension and incur late fees.Refunds are not provided for completed work or ongoing services.


5. Intellectual Property


All materials created by the Agency, including but not limited to advertisements, graphics, website content, and marketing strategies, remain the property of the Agency until full payment is received. Upon full payment, rights may be transferred to the client as specified in individual agreements.


6. Client Responsibilities


Clients agree to:


Provide necessary access, information, and approvals in a timely manner.Ensure compliance with all applicable laws and regulations related to their business and marketing materials.Acknowledge that marketing performance varies and is influenced by external factors beyond the Agency’s control.


7. Confidentiality


Both parties agree to keep confidential any proprietary information shared during the engagement. The Agency will not disclose client data to third parties without consent, except as required by law.


8. Limitation of Liability


The Agency is not responsible for any business losses, including but not limited to revenue loss, data loss, or reputational damage arising from the use of our services. Our liability is limited to the total amount paid by the client for services rendered.


9. Termination


Either party may terminate services with written notice. If termination occurs after services have been performed, the client remains responsible for payment of work completed up to the termination date.


10. Dispute Resolution


In the event of a dispute, both parties agree to attempt to resolve matters through negotiation or mediation before pursuing legal action. Any disputes shall be governed by the laws of the State of Illinois and resolved in the courts located in DuPage County, Illinois.


11. Modifications


We reserve the right to update these Terms and Conditions. Clients and users will be notified of any significant changes. Continued engagement with our services constitutes acceptance of the revised terms.
